Terms and Conditions of Purchase

General Provisions

These Terms and Conditions of Purchase (hereinafter referred to as the “Terms”) constitute an agreement between MB “Estheticut”, legal entity code 306339302, with its registered office at Stirnų g. 66-3, Noreikiškės, Lithuania (hereinafter referred to as the “Seller”), and you, under which the Seller provides you with the opportunity to purchase products offered in the online store at www.estheticut.com (hereinafter referred to as the “Online Store”; the products are hereinafter referred to as the “Products”).

You may purchase Products through the Online Store only if you are legally capable of entering into a binding contract with the Seller and agree to comply with these Terms and applicable laws. If you are under 18 years of age, you may purchase Products through the Online Store only with the consent of your parents or other legal representatives. By placing an order, you confirm that you are at least 18 years old or have obtained the consent of your parents or other legal representatives.

Purchasing Products Through the Online Store

When you visit the Online Store and select Products, a shopping cart is created based on your selection.

Once your shopping cart has been created, you must enter the information required to deliver the selected Products. Please ensure that all information provided is correct and that the Products you order meet your requirements. You may correct any errors before confirming your order. Your personal data will be processed for the purposes and in accordance with the procedures set out in our Privacy Policy.

By placing an order through the Online Store, you agree to pay the price of the Products specified in your order. The prices displayed in the Online Store and stated in your order include all applicable taxes but exclude delivery charges, which must be paid separately unless otherwise stated in the Online Store. All prices are quoted in euros (EUR).

You may pay for your Products using the following methods: electronic banking, bank transfer, bank card, or cash.

Payments may be made using the electronic banking services of Swedbank, SEB, Luminor, Citadele, and Šiaulių Bankas. Payments are processed in euros through the MakeCommerce.lt payment platform.

Payment must be completed within one (1) day of placing your order.

Once you confirm your order, the Seller receives all relevant order information. Your order is considered submitted when it is received by the Seller. At that point, a purchase agreement is considered to have been concluded between you and the Seller. However, the Seller is required to fulfil the agreement only after receiving confirmation from the payment service provider that payment for the Products has been completed.

After placing your order, you will receive an email at the address you provided, confirming the Products ordered and the information you submitted.

Once the Seller receives confirmation that payment for the ordered Products has been made, the Seller undertakes to fulfil your order.

Product Features and Quality

The features of each Product are described in its listing in the Online Store. The Seller endeavours to ensure that all Products comply with applicable legal requirements and are suitable for their intended use.

By placing an order, you acknowledge and understand that the colours, shapes, dimensions, and other visual characteristics of Products displayed in the Online Store may differ from the actual appearance of the Products due to the characteristics or settings of your monitor or other device. Such differences will not be considered Product defects unless they result from actions or omissions by the Seller or third parties associated with the Seller.

The Seller undertakes to supply Products that correspond to the information provided in their descriptions in the Online Store. The Seller also undertakes to supply the assortment and quantities specified in your order, except where any discrepancy results from incorrect information provided by you when placing the order.

Product Delivery

When ordering Products, you must select one of the delivery methods offered in the Online Store and provide the delivery address.

Please note that the stated delivery times are estimates. Although we always endeavour to fulfil orders as quickly as possible, preparation or delivery may occasionally take longer due to a high volume of orders or the workload of delivery service providers. The Seller will provide updates on the delivery status. Please monitor these updates. Once your parcel has been dispatched, you can track it using the tracking number provided by the delivery service provider.

If, upon receiving your Products, you discover that any ordered Product is missing from the parcel, please notify the Seller without undue delay.

Products are packaged appropriately for their nature to help ensure that they arrive in a condition suitable for their intended use.

Product Exchanges and Returns

The rules governing Product exchanges and returns are set out separately in the Online Store and form an integral part of these Terms.

Intellectual Property

The trademarks and other distinctive signs used on the Products belong to the Seller and/or other rights holders and are protected by applicable law. All intellectual property rights in the Products and their individual components also belong to the Seller and/or other rights holders.

The trademarks and logos used in the Online Store, the domain name, the Online Store itself, the website on which it is hosted, and all individual elements thereof—including texts, photographs, illustrations, and other materials published in the Online Store or on the website—as well as the layout, appearance, and design of any page of the Online Store or website, are the exclusive intellectual property of the Seller and/or other rights holders.

You agree not to copy, modify, reproduce, or otherwise use these intellectual property assets without the prior written consent of the relevant rights holder.

Liability

The Seller’s liability for Product quality and delivery is governed by applicable laws.

You must provide the Seller with all requested information accurately and completely. You are responsible for providing the correct delivery address.

You are responsible for keeping your username, password, and any other information used to access the Online Store secure. If you become aware of any unauthorised use of your username or password, please contact the Seller immediately.

Amendments and Termination

The Seller may amend these Terms from time to time. The latest applicable version will always be available in the Online Store. Before confirming an order, you must review the version of the Terms in force at that time. Each order will be governed by the version of the Terms in force when the order was confirmed.

The Seller reserves the right to discontinue the operation of the Online Store at any time. Such discontinuation will not affect purchase agreements that are already in force.

Other Provisions

These Terms and any purchase agreement shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.

Any disputes, disagreements, or claims arising from or relating to these Terms or an individual purchase agreement, including disputes concerning their breach, termination, or validity, shall be resolved by the courts of the Republic of Lithuania in accordance with applicable Lithuanian law, subject to any mandatory consumer protection rules.

The authority responsible for the out-of-court settlement of consumer disputes arising under these Terms is the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba).

Information about consumer dispute resolution bodies in European Union Member States is available through the European Commission’s consumer dispute resolution resources.

All notices and other communications relating to purchases through the Online Store or these Terms shall be sent by email. Communications to the Seller shall be sent to the email address specified at the beginning of these Terms. Communications to you shall be sent to the email address provided when placing your order.

If any provision of these Terms is or becomes wholly or partially invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
